Welcome to Clear Path To Cash (“Clear Path To Cash,” “Company,” “we,” “us,” or “our”), a financial insights platform owned and operated by Cash Flow Mike LLC. These Terms of Service (“Terms”) govern your access to and use of our websites, software applications, membership services, digital content, courses, tools, templates, reports, and related services (collectively, the “Services”).

By accessing or using the Services, you agree to be legally bound by these Terms. If you do not agree, do not access or use the Services.

Legal notices must be sent via first-class mail to the address above. Notices will be considered received five (5) business days after mailing.

  1. ELIGIBILITY & USER RESPONSIBILITY

You must be at least 18 years old to use the Services.

You agree that you are responsible for all use of the Services under your account, including any actions taken by your employees, contractors, team members, or authorized users.

  1. ACCOUNT REGISTRATION & SECURITY

To access certain Services, you must create an account.

You agree to:

  • Provide accurate and complete registration information
  • Maintain the confidentiality of your login credentials
  • Promptly notify us of any unauthorized access or security breach

You are responsible for all activity that occurs under your account.

  1. SUBSCRIPTIONS, BILLING, TRIALS & CANCELLATION

4.1 Subscription Plans

Clear Path To Cash offers subscription memberships that may include access to software tools, templates, community access, live training, certification programs, and digital content. Plan features vary.

4.2 Billing & Auto-Renewal

Subscriptions are billed in advance and automatically renew unless canceled before the renewal date. By purchasing a subscription, you authorize recurring billing through our payment processor.

4.3 Trials

If you enroll in a free trial, your trial may automatically convert into a paid subscription unless canceled before the trial ends.

4.4 Cancellation

You may cancel your subscription at any time. Cancellation will take effect at the end of the current billing cycle. No prorated refunds will be issued unless required by law.

4.5 Refund Policy

All payments are non-refundable unless otherwise stated in writing or required by law.

  1. CERTIFICATION & CPE CREDIT TERMS

Certain membership plans include eligibility for the Clear Path To Cash Professional (CPCP) designation and/or Continuing Professional Education (CPE) credit.

You acknowledge and agree:

  • Certification is earned, not guaranteed
  • Requirements may include attendance, assessments, assignments, exams, and verification steps
  • You are responsible for confirming whether CPE credits meet your licensing board’s requirements
  • Failure to complete requirements may result in ineligibility for certification/CPE

We reserve the right to update certification requirements as needed to maintain quality, accreditation compliance, or program standards.

  1. PERMITTED USE & RESTRICTIONS

You may use the Services only for lawful business purposes.

You may not:

  • Copy, resell, license, sublicense, or distribute the Services without written permission
  • Reverse engineer, scrape, extract source code, or attempt unauthorized access
  • Share your login credentials or allow unauthorized account use
  • Use the Services to violate privacy laws, financial regulations, or intellectual property rights
  • Use the Services to build a competing product or service

We reserve the right to suspend or terminate accounts that violate these Terms.

  1. INTELLECTUAL PROPERTY RIGHTS

All content, software, workflows, calculations, reports, videos, training content, worksheets, templates, frameworks, and materials provided through the Services are owned by Cash Flow Mike LLC and protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Services for your internal business use only.

  1. WHITE LABELING & BRAND USAGE

Certain plans may allow you to add your logo to reports or documents generated through the Services.

You acknowledge and agree:

  • White labeling does not transfer ownership of the underlying system or report structure
  • Reports may include a “Powered by Clear Path To Cash” statement
  • You may not remove trademarks, disclaimers, copyright notices, or required attribution
  1. THIRD-PARTY SERVICES & INTEGRATIONS (INCLUDING QUICKBOOKS)

The Services may integrate with third-party platforms such as QuickBooks Online and other tools.

You acknowledge and agree:

  • Third-party services are not controlled by Cash Flow Mike LLC
  • Availability of integrations may change at any time
  • We are not responsible for third-party outages, changes, data errors, API limitations, or access restrictions

Your use of third-party services is governed by their own terms and policies.

  1. AI-DRIVEN INSIGHTS & EDUCATIONAL DISCLAIMER

The Services may provide financial insights, forecasts, benchmarking, predictive modeling, automated recommendations, and other outputs that may be supported by algorithms and AI.

You acknowledge and agree:

  • Outputs are informational and educational only
  • Outputs may be incomplete, incorrect, delayed, or based on inaccurate inputs
  • You are solely responsible for verifying accuracy and applying judgment
  • Clear Path To Cash is not responsible for business decisions made using the Services

We do not guarantee results, profitability, financing outcomes, or business success.

  1. NO PROFESSIONAL ADVICE

Clear Path To Cash is not a CPA firm, law firm, investment advisory service, or tax preparation business.

Nothing in the Services constitutes:

  • Legal advice
  • Tax advice
  • Investment advice
  • Accounting or audit assurance
  • Financial planning services

You should consult licensed professionals before making financial decisions.

  1. USER CONTENT & DATA INPUT

You may enter business information into the Services, including financial statement data, operational data, and business performance data (“User Content”).

You retain ownership of your User Content.

By using the Services, you grant Cash Flow Mike LLC permission to host, store, process, display, and analyze your User Content solely to provide and improve the Services.

  1. SERVICE AVAILABILITY

We aim to provide reliable access, but the Services may occasionally be unavailable due to:

  • Maintenance
  • Platform updates
  • Hosting outages
  • Third-party provider interruptions

We do not guarantee uninterrupted service availability.

  1. TERMINATION & SUSPENSION

We reserve the right to suspend or terminate your account if:

  • You violate these Terms
  • Your use creates security risk or legal exposure
  • Fraudulent activity is suspected
  • Required payments are not received

Upon termination, your access to the Services will end immediately.

  1. DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND AVAILABILITY.

  1. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CASH FLOW MIKE LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, LOST REVENUE, OR BUSINESS INTERRUPTION ARISING OUT OF OR RELATING TO THE SERVICES.

OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT PAID BY YOU TO CASH FLOW MIKE LLC IN THE PRIOR THREE (3) MONTHS.

  1. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Cash Flow Mike LLC from any claims, damages, losses, liabilities, or expenses arising from:

  • Your use of the Services
  • Your User Content
  • Your violation of these Terms
  • Your violation of any law or third-party rights
  1. FORCE MAJEURE

We are not responsible for delays or failures caused by events beyond our reasonable control, including cyberattacks, third-party outages, natural disasters, labor disputes, or government actions.

  1. GOVERNING LAW & VENUE

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.

Any dispute must be brought exclusively in the state or federal courts located in Bexar County, Texas.

  1. CHANGES TO THESE TERMS

We may update these Terms from time to time. Updated Terms will be posted with a revised effective date.

Continued use of the Services after updates constitutes acceptance.

  1. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, represent the entire agreement between you and Cash Flow Mike LLC regarding the Services.
